It is hard to obtain asylum and most applications are denied. Asylum is not given simply because your home country has a high crime rate. If you are in the U.S. you may only be granted asylum if you can show a “well founded fear of persecution” based on (1) race, (2) religion, (3) nationality, (4) political opinion, or (5) membership in a particular social group. The fear of persecution must be either by the government of his or her country or by a group that the government is unable or unwilling to control. The ultimate result of asylum status is adjustment of status to permanent residence.

The applicant must apply for asylum within 1 year of entering the United States or be able to show that either the country conditions have changed or your personal circumstances have changed within the past year prior to your seeking asylum. You may apply for asylum regardless of your immigration status, meaning that you may apply even if you are illegally in the United States.
