Since 2017, the Trump travel ban placed restrictions on travel to the United States by citizens of Iran, Libya, Somalia, Sudan, Syria, and Yemen (Executive Order 13769). Iraq was originally part of the countries to have restrictions placed on it but it has since been removed from the list. More recently, Presidential Proclamation 9645 added restrictions on Chad, North Korea, and Venezuelan, while Sudan was removed from the list.
In a 5 to 4 decision, the United States Supreme Court found the travel ban was within the considerable authority U.S. presidents have over immigration and their responsibility for keeping the nation safe and did not outlaw the travel ban.
On 31 January 2020, the Trump administration announced the expansion of the travel ban on six more countries. However, this ban only affects certain visas for residents in countries of Eritrea, Kyrgyzstan, Myanmar, Nigeria, Sudan, and Tanzania. This extended is expected to be implemented on February 21st, 2020.
The only way a citizen from any of the countries listed above can travel to the USA is if the person qualifies for a “waiver” of the travel ban. Although qualifying for a waiver of the travel ban is a difficult task to accomplish, our law office has been successful in having many waivers of the travel ban granted. In order to learn more information about “waivers of the travel ban”, or to have your case evaluated for the qualification of a waiver of the travel ban, please contact our office to set up a consultation appointment.
